Se transcribe fallo dictado por la Cámara Civil y Comercial de la ciudad de Dolores (luego de una apelación efectuada por el Dr. Juan Martín Ferraro), el cual establece que a los Defensores de Pobres y Ausentes y Asesores de menores se les deberán regular no sólo honorarios profesionales, sino que también aportes previsionales.-

VOCES. APORTES PREVISIONALES. DEFENSORES Y ASESORES AD HOC
En la ciudad de Dolores, a los tres días del mes de septiembre del año dos mil diecinueve, reunida la Excma. Cámara de Apelación en lo Civil y Comercial de este Departamento Judicial, en Acuerdo Ordinario, con el objeto de dictar sentencia en causa Nº 97.803, caratulada: «DR. JUAN MARTÍN FERRARO S/ INCIDENTE DE APELACIÓN (EN AUTOS CARATULADOS «VEGA, CARLOS ALEJANDRO S/ SU SITUACIÓN EXPTE. N° 24.208», votando los Señores Jueces según el siguiente orden Dres. Silvana Regina Canale; Mauricio Janka y María R. Dabadie.
El Tribunal resolvió plantear y votar las siguientes:
C U E S T I O N E S
Primera cuestión ¿Es justa la sentencia apelada?
Segunda cuestión ¿Qué corresponde decidir?
V O T A C I Ó N
A LA PRIMERA CUESTIÓN PLANTEADA LA SEÑORA JUEZA DOCTORA CANALE DIJO:
- Vienen los autos a conocimiento de Tribunal en virtud del recurso de apelación interpuesto en forma subsidiaria por el Dr. Ferraro a fs. 67/67 vta. contra el auto de fs. 61, el que se fundamenta en el mismo acto de su deducción.
Se agravia el recurrente de la providencia apelada al no considerar el pago de los aportes correspondientes, vulnerando de esa forma expresamente el art. 12 inc. a) de la ley 6.716 (texto según leyes 10.268 y 11.625) y lesionando sus derechos a integrar en su cuenta los aportes previsionales.
Subsidiariamente, menciona jurisprudencia respaldatoria de su postura.
- Abordando la cuestión en análisis, es dable señalar que el art. 12 de la ley 6.716 (según texto leyes 10.268 y 11.625) establece que el capital de la Caja de Abogados de la Provincia de Buenos Aires se forma con el 10 % de toda remuneración profesional que devenguen los afiliados y con el 5 % a cargo de la personas obligadas a su pago en los juicios voluntarios y con el diez (10) por ciento en los contradictorios.
En el caso que nos ocupa, el Dr. Juan Martín Ferraro fue designado como Asesor de Incapaces Ad Litem de acuerdo a lo normado por el art. 91 de la ley 5.827 (v, fs. 28/29), y en virtud de la normativa citada a fs. 61 le fueron regulados sus honorarios, a cargo del Poder Judicial de la Provincia de Buenos Aires.
Cuando se requiere la intervención del Defensor Oficial o Asesor de Incapaces en el ámbito de la Justicia de Paz Letrada, deben desinsacularse, de las listas que confeccionan anualmente los Colegios de Abogados Departamentales (art. 91 ley 5.827).
Ahora bien, toda actividad profesional, ya sea en forma autónoma como es el caso de los Defensores de Pobres y Ausentes y Asesores de Incapaces ad hoc, o en relación de dependencia como los funcionarios del Ministerio Público, debe aportar a las Cajas Previsionales; ello no solo es un derecho sino también una obligación.
Así como los letrados aportan por su actividad profesional privada y el obligado al pago del honorario en el porcentaje establecido (art. 12, inc. a, ley 6.716) (texto según leyes 10.268 y 11.625) y el Poder Judicial lo hace con sus funcionarios dependientes, no se advierte razón alguna para que en los casos como el que nos ocupa, ello no sea así, debiendo el Poder Judicial como obligado al pago de los honorarios que también lo sea de los aportes previsionales correspondientes.
El abogado debe cumplir con un aporte mínimo anual para tener derecho a una jubilación (art. 12, inc. b, ley 6.716) (texto según leyes 10.268 y 11.625); por lo tanto el no pago de aportes por esta actividad, resulta sin dudas un menoscabo no sólo para la Caja de Previsión Social para Abogados, sino también al interés del letrado, amparados por el orden público que alcanza a las leyes previsionales.
Por otra parte, debe destacarse que a raíz de una sentencia dictada por la Cámara Civil y Comercial del Departamento Judicial de Necochea, la comisión de control de aportes a través del Directorio de la Caja de Previsión para abogados de la Provincia de Buenos Aires mediante Acta N° 929 del 14/2/2019 solicitó al Sr. Presidente de la SCBA, la implementación de un sistema de comunicación de las regulaciones impuestas al Poder Judicial, conforme lo normado por el art. 91 de la ley 5.827 que contempla la intervención de las figuras del Defensor de Pobres y Ausentes o del Asesor de Incapaces, a fin que cuando se paguen los estipendios correspondientes a las actuaciones de los letrados en dicho carácter, se abone también la contribución previsional que establece el art. 12 inc. a de la ley 6.716, la que deberá ingresar en la cuenta de aporte del letrado que hubiera merecido la regulación.
En ese contexto, no surgiendo que la SCBA se haya pronunciado en el sentido de excepcionar a los jueces de la carga impuesta en el art. 16 de la ley 6.716 texto según ley 11.625, ni de las responsabilidades que se imponen a los funcionarios judiciales en los arts. 15 y 18 según ley 10.268, y existiendo a la fecha una norma expresa en tal sentido, en los casos de regulaciones fijadas a los Defensores y Asesores Ad Hoc por su actuación en la Justicia de Paz Letrada, han de aplicarse dichas disposiciones en la materia (Cámara Civil Y Comercial de Necochea causas n° 11.482 (6/12/2018) y (06/06/2019).
Ello así más allá del dictamen emitido por el Secretario General de la Procuración de la Provincia de Buenos Aires que amparado en garantizar el acceso a la justicia considera que los letrados que presten sus servicios en el marco del artículo 91 de la ley 5.827, texto según ley 14.365 (Ac. 3912 SCBA), debe recibir sólo una compensación por esa actividad y sin dudas no es así porque no se trata de una asistencia jurídica gratuita, sino de un profesional que se inscribe para cumplir una función y como tal merece retribución legal y consecuentemente con ello el aporte previsional.
No puede olvidarse además que esa participación resulta necesaria para el Poder Judicial, pues la normativa legal vigente art. 91 ley 5.827, texto según Ley 14.365, exige esa asistencia letrada gratuita como la intervención de Asesores de Incapaces de las leyes así lo determinen (art. 103 del CCyCN) y al no contar el Poder Judicial con los funcionarios respectivos en el ámbito de la Justicia de Paz Letrada, necesariamente debe recurrir a los propios de la matrícula.
Siendo así, no cabe dudas que como se dijo la remuneración debe estar acompañada del aporte previsional a cargo del Poder Judicial.
Ahora bien, siendo que la normativa que rige esa intervención no contiene precisión alguna al respecto y tampoco la ley de la Caja de Previsión Social para abogados de la Provincia de Buenos Aires hace referencia alguna, deberán los operadores adoptar las medidas pertinentes para extender la obligatoriedad de cumplir con los aportes previsionales al Poder Judicial.
Por lo que entiendo que corresponde receptar el recurso de apelación en subsidio interpuesto a fs. 67/67 vta., debiendo en la instancia de origen cumplirse con lo dispuesto por el art. 16 de la ley 6.716 respecto de los honorarios fijados al Dr. Juan Martín Ferraro conforme el art. 91 de la ley 5827 en el auto de fs. 61.
III. Costas. Sin costas atento la naturaleza de la cuestión decidida.
VOTO POR LA NEGATIVA.
A LA MISMA PRIMERA CUESTIÓN PLANTEADA EL SEÑOR JUEZ DOCTOR JANKA DIJO:
- Adhiero a los fundamentos en que se sustenta el voto precedente, agregando lo siguiente.
La Constitución obliga al Estado a otorgar a los trabajadores los beneficios de la seguridad social (arts. 14 bis párr. 3º, 121 y 125 pár. 2º, Const. Nacional), reconociéndose a nivel provincial la existencia de cajas y sistemas de seguridad social de profesionales (arts. 39 pto. 3º y 40 Const. Pcia. de Bs. As.).
En ese contexto constitucional, y tal como señaló la distinguida colega preopinante, el régimen legal de la Caja de Previsión Social para Abogados de la Provincia de Buenos Aires, estatuido por ley 6.716 (t.o. según leyes 8.455, 10.268, dec. ley 9.978/83, 11.625, 12.259 y 12.526), establece que el capital de dicha persona jurídica de derecho público se integrará –entre otros ingresos- con el 10 % de toda remuneración profesional que devenguen los afiliados y con el 5 % de esos mismos honorarios a cargo de las personas obligadas a su pago en los juicios voluntarios y con el 10 % en los contradictorios (art. 12 inc. a).
Asimismo, la citada norma prevé que los órganos jurisdiccionales, al practicar la regulación de honorarios de abogados, adicionarán a la misma el porcentual a cargo de la parte obligada a su pago (art. 16).
En la especie, el Dr. Juan Martín Ferraro ha actuado en el expediente principal, en trámite ante el Juzgado de Paz Letrado de Gral. Madariaga, en carácter de Asesor de Incapaces ad hoc, en los términos del art. 91 de la ley 5.827, Orgánica del Poder Judicial (conf. art. 103 CCyCN; art. 15 C. Pcial.).
Esta norma establece en su párrafo 6º que: “Por su intervención el letrado percibirá una remuneración con cargo al presupuesto del Poder Judicial, en la forma que establezca la reglamentación de la Suprema Corte de Justicia, que deberá prever una escala de honorarios a valores de la unidad arancelaria prescripta por el decreto ley 8.904/77 [hoy ley 14.967], a fin de que el Juez de Paz Letrado regule los honorarios en orden a la importancia y complejidad del trabajo realizado”.
En cumplimiento de ello y mediante Ac. 2341 (texto según Ac. 3912), la Suprema Corte de Justicia dispuso: “Fijar una escala entre 2 (dos) y 8 (ocho) jus de acuerdo con el valor establecido por el artículo 9 de la ley 14.967, para la retribución a percibir por los abogados intervinientes en calidad de Defensores Oficiales y/o Asesores de Incapaces ante la Justicia de Paz Letrada, conforme la regulación de honorarios que efectúe el respectivo Juez, en orden a la importancia y complejidad del trabajo realizado (art. 91 de la ley 5.827, texto según Ley 14.365)».
Nótese que la ley 6.716, al establecer sobre qué tipo de retribuciones se establecen los aportes y contribuciones, refiere claramente a que éstos se deben abonar a la Caja con relación a “toda remuneración profesional que devenguen los afiliados”, sin efectuar distingos de ninguna naturaleza en orden a bajo qué norma se regulan los honorarios, ni quién resulte obligado a su pago.
De la interpretación armónica de las normas transcriptas, sólo puede concluirse que el Poder Judicial, como sujeto obligado al pago de los honorarios correspondientes al letrado apelante por su intervención en los autos principales como Asesor ante la Justicia de Paz Letrada, debe cumplir con el pago de la contribución previsional que le corresponde (5% de los honorarios regulados en juicios voluntarios y 10% contradictorios), sin que se advierta la existencia de disposición legal alguna que permita exceptuarlo de tal obligación.
Huelga aclarar que el incumplimiento de tal manda legal no puede sustentarse en el criterio que en forma consuetudinaria se ha mantenido hasta la fecha, en punto a no exigir al Poder Judicial el cumplimiento del porcentual de aportes correspondiente.
Consecuentemente, el a quo deberá dar cabal cumplimiento con el art. 16 de la ley 6.716, para lo cual adicionará a los honorarios regulados el porcentual de contribución previsional a cargo del obligado a su pago (Poder Judicial).
- Resta señalar que el hecho de que el Dr. Ferraro no haya abonado el anticipo previsto en el art. 13 de la ley 6.716 (como así también que el órgano judicial no haya exigido el cumplimiento de tal obligación), no incide en absoluto en la solución propiciada.
Lo mismo ocurre con relación a la supuesta afectación del erario público que –según el a quo- se produciría en caso de tener que abonar el Poder Judicial Provincial las correspondientes contribuciones previsionales de todos los letrados que actúen como Defensores de Pobres y Ausentes y/o Asesores de Incapaces ad hoc; o con la hipotética afectación de los ingresos de tales letrados que deberán cargar con el aporte previsional del 10 % de sus emolumentos devengados.
Es que no debe olvidarse que los beneficios de la seguridad social son irrenunciables, tal como expresamente lo dispone la Carta Magna (art. 14 bis), y de orden público; por lo que no resulta argumento útil para exceptuar el cumplimiento de las cargas previsionales la mayor o menor onerosidad y/o conveniencia que ello revista para los obligados a su pago (léase letrado afiliado y obligado al pago de los estipendios, sea éste el Estado o cualquier otra persona).
III. Y por último, entiendo que corresponde comunicar lo aquí decidido a la Suprema Corte de Justicia y a la Procuración General, en tanto resultan sujetos obligados al pago de la obligación previsional (conf. art. 91 pár. 6º ley 5.827 y 12 inc. a ley 6.716); a la Caja de Previsión Social para Abogados, en su carácter de acreedora de la obligación antes aludida; y a la Defensoría General Departamental, a cargo de la superintendencia con relación a los defensores y asesores ad hoc que actúan ante la Justicia de Paz Letrada (art. 92 ley 5.827).
En los términos aquí vertidos, adhiero al voto de la Dra. Silvana R. Canale, votando también por la NEGATIVA.
LA SEÑORA JUEZA DOCTORA DABADIE ADHIRIÓ AL VOTO PRECEDENTE POR SUS FUNDAMENTOS.
A LA SEGUNDA CUESTIÓN PLANTEADA LA SEÑORA JUEZA DOCTORA CANALE DIJO:
En virtud de los argumentos dados, en tanto mi opinión resulte compartida, corresponde receptar el recurso de apelación en subsidio interpuesto a fs. 67/67 vta., debiendo en la instancia de origen cumplirse con lo dispuesto por el art. 16 de la Ley 6.716 respecto de los honorarios fijados al Dr. Juan Martín Ferraro conforme el art. 91 de la ley 5.827 en el auto de fs. 61. Sin costas atento la naturaleza de la cuestión decidida.
Comunicar lo aquí decidido a la Suprema Corte de Justicia y a la Procuración General, en tanto resultan sujetos obligados al pago de la obligación previsional (conf. art. 91 pár. 6º ley 5.827 y 12 inc. a ley 6.716); a la Caja de Previsión Social para Abogados, en su carácter de acreedora de la obligación antes aludida; y a la Defensoría General Departamental, a cargo de la superintendencia con relación a los defensores y asesores ad hoc que actúan ante la Justicia de Paz Letrada (art. 92 ley 5.827).
ASI LO VOTO.
LOS SEÑORES JUECES DOCTORES JANKA Y DABADIE ADHIRIERON AL VOTO PRECEDENTE POR SUS FUNDAMENTOS.
CON LO QUE TERMINÓ EL PRESENTE ACUERDO, DICTÁNDOSE LA SIGUIENTE
S E N T E N C I A
Por los fundamentos expuestos en el Acuerdo que antecede, los que se tienen aquí por reproducidos, este Tribunal recepta el recurso de apelación en subsidio interpuesto a fs. 67/67 vta., debiendo en la instancia de origen cumplirse con lo dispuesto por el art. 16 de la ley 6.716 respecto de los honorarios fijados al Dr. Juan Martín Ferraro conforme el art. 91 de la ley 5.827 en el auto de fs. 61. Sin costas atento la naturaleza de la cuestión decidida.
